Terms & Conditions
THESE TERMS AND CONDITIONS APPLY TO SERVICES PROVIDED BY WOODFORD GARDENING SERVICES LTD. BY ACCEPTING A QUOTATION OR INSTRUCTING US TO BEGIN WORK, THE CUSTOMER AGREES TO THE FOLLOWING TERMS.
1. Quotations Quotations are provided free of charge and are normally valid for 14 days from the date of issue, unless stated otherwise. Quotations are based on the information available and the visible condition of the site at the time of assessment. If additional work, unforeseen conditions or changes to the original requirements arise, we may provide a revised quotation or agree additional charges before continuing.
2. Acceptance of Work A quotation may be accepted verbally, in writing, electronically or by allowing work to begin. Acceptance confirms that the customer agrees to the scope of work, price and these Terms and Conditions. Any requested changes to the agreed work may affect the price and completion timescale.
3. Access to the Property The customer must provide safe and reasonable access to the property and working area at the agreed time. Where the customer will not be present, arrangements involving gates, keys or key safes must be agreed beforehand. The customer is responsible for ensuring that any access information provided is accurate and up to date. If suitable access is unavailable, the visit may be treated as a late cancellation and a charge may apply.
4. Customer Responsibilities The customer must inform us of any known hazards, underground services, cables, pipes, drainage systems, protected plants, access restrictions or other matters that could affect the safe completion of the work. Working areas should be kept reasonably clear of personal belongings, vehicles, pets and other obstructions. Children and pets must be kept away from tools, machinery and active working areas.
5. Cancellations and Missed Visits Customers must provide at least 24 hours’ notice when cancelling or rearranging an appointment. A charge may be made for late cancellations, missed appointments or visits where work cannot proceed because suitable access has not been provided. Woodford Gardening Services Ltd may need to postpone or reschedule work due to unsuitable weather, safety concerns, staff availability or circumstances beyond the company’s reasonable control.
6. Weather and Delays Gardening and landscaping work is affected by weather and ground conditions. We reserve the right to delay, suspend or reschedule work where conditions could affect safety, quality or our ability to complete the service properly. We will make reasonable efforts to notify the customer and arrange a suitable alternative date. We are not responsible for delays caused by circumstances outside our reasonable control.
7. Regular Garden Maintenance Regular maintenance may be arranged weekly, fortnightly or monthly, subject to availability and the agreed service schedule. The amount of work completed during each visit will depend on the agreed time, site conditions, seasonal growth and accessibility. Additional work outside the agreed maintenance service may be quoted separately. Maintenance schedules may occasionally change due to weather, bank holidays, staff availability or other operational requirements.
8. Garden Waste Green waste and general garden waste will only be removed where this has been included within the quotation or agreed service. Additional waste, excessive quantities or materials that were not visible or disclosed when the quotation was prepared may be subject to an additional charge. Woodford Gardening Services Ltd holds the appropriate waste carrier registration for transporting waste produced as part of its business activities.
9. Plants and Living Materials Plants, turf and other living materials are affected by weather, soil conditions, pests, disease, watering and ongoing care. Their continued health or survival cannot be guaranteed unless a specific written guarantee has been provided. Unless ongoing maintenance or aftercare has been agreed, the customer is responsible for watering, feeding and caring for newly installed plants, turf and soft landscaping after the work has been completed. Woodford Gardening Services Ltd is not responsible for plant loss or deterioration caused by inadequate aftercare, extreme weather, pests, disease or circumstances outside the company’s reasonable control.
10. Jet Washing Jet washing will only be undertaken on surfaces considered suitable for the service. Results will depend on the age, material, condition and previous treatment of the surface. Jet washing may expose existing damage, discolouration, loose pointing, worn coatings or other defects that were not previously visible. We cannot guarantee the complete removal of every stain, mark, weed, lichen or area of discolouration.
11. Tree Surgery and Subcontracted Services Specialist tree surgery work is carried out through a trusted and appropriately qualified subcontractor and coordinated by Woodford Gardening Services Ltd. Hard landscaping services, including patios, paving, driveways, decking and fencing, may also be provided through the company’s subcontractor network. Where subcontractors are used, the customer will be informed where appropriate. The scope, price and arrangements for the work will be confirmed before it begins.
12. Materials Materials will be selected and supplied in accordance with the accepted quotation. Natural products such as timber, stone, turf and plants may vary in colour, texture, size and appearance. Wood and other natural materials may change over time due to weathering, moisture and seasonal conditions. These natural variations are not considered defects. Materials remain the property of Woodford Gardening Services Ltd until payment has been received in full, where permitted by law.
13. Additional and Unforeseen Work If unforeseen problems are discovered after work begins, we will explain the issue and discuss any additional work or costs with the customer. Additional work will not normally proceed without the customer’s agreement, except where immediate action is reasonably necessary to make the site safe or prevent further damage.
14. Completion of Work Work will be considered complete when the agreed services have been carried out substantially in accordance with the accepted quotation. The customer should raise any concerns as soon as reasonably possible so that we have an opportunity to inspect and, where appropriate, correct the issue. Minor variations that do not materially affect the use, quality or appearance of the completed work will not normally be treated as a failure to fulfil the agreement.
15. Payment Payment terms, including any required deposit, staged payments and final payment date, will be stated on the quotation or invoice. Invoices must be paid using the payment method and within the period specified. If payment is not received when due, Woodford Gardening Services Ltd reserves the right to suspend further work and take reasonable steps to recover the outstanding amount. Any concerns about an invoice should be raised promptly.
16. Insurance and Liability Woodford Gardening Services Ltd holds £5 million in public liability insurance. We will take reasonable care when providing services. However, we will not be responsible for pre-existing damage, defects, undisclosed hazards or losses caused by inaccurate or incomplete information supplied by the customer. Nothing in these Terms and Conditions excludes or limits liability where doing so would be unlawful, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation.
17. Damage and Existing Defects The customer should notify us of fragile items, concealed services, damaged surfaces or other known risks before work begins. We are not responsible for damage resulting from defects, deterioration, poorly installed materials, unstable structures or other conditions that could not reasonably have been identified before work started. If accidental damage is caused directly by our work, the customer should notify us promptly and allow us a reasonable opportunity to inspect the damage.
18. Photographs We may take photographs before, during or after work for record-keeping and quality-control purposes. Photographs will only be used for marketing purposes with the customer’s permission. We will take reasonable steps to avoid displaying identifying information without consent.
19. Complaints Any complaint should be raised as soon as reasonably possible after the issue becomes apparent. We will investigate the matter and, where appropriate, arrange an inspection or propose a reasonable solution. Customers must allow us a reasonable opportunity to address concerns before arranging corrective work through another contractor.
20. Consumer Rights Nothing in these Terms and Conditions affects the customer’s statutory rights under applicable consumer law. Where the customer is entitled to a cancellation period for a contract agreed away from the company’s business premises, work will not begin during that period unless the customer has expressly requested an earlier start. The customer may be required to pay for services supplied before cancellation.
21. Privacy Personal information will be handled in accordance with the company’s Privacy Policy and applicable UK data protection legislation. Customer information will only be used where reasonably necessary to provide services, manage accounts, communicate about work and meet legal or regulatory obligations.
22. Governing Law These Terms and Conditions are governed by the laws of England and Wales. Any dispute will be subject to the jurisdiction of the courts of England and Wales.
